In Oregon, you are required to file an accident report with the Oregon Department of Motor Vehicles (1) if the damage to any vehicle involved in the accident exceeds $2,500, (2) if any vehicle is towed from the scene due to damage, (3) if the accident results in injuries or fatalities, or (4) if there is property damage not involving a vehicle that exceeds $2,500.
Oregon operates under an “at-fault” system for car accidents. This means the driver at fault for causing the accident is responsible for any resulting harm. So, if you are involved in an accident, you have the option to file a claim with your own insurance company or pursue a personal injury lawsuit against the at-fault driver to seek compensation for accident-related expenses.
In Oregon, you generally have two years from the date of the car accident to initiate a lawsuit for personal injuries. This time limit, known as the statute of limitations, is crucial to adhere to if you wish to seek compensation for damages and injuries caused by the accident.
If you had valid insurance within 180 days before the accident and didn’t drive uninsured for a year before your coverage lapsed, you may still recover compensation. Consult our Oregon auto collision attorneys to initiate the claims process and secure the maximum compensation you are entitled to.
Senft Legal operates under a contingency fee basis. This means you won’t face any upfront costs; a standard attorney fee is applied to your final settlement amount. This fee ranges from 33-40% depending on the complexity of your case.
The amount you can expect from a car accident settlement in Oregon depends on several factors. The severity of your injuries is the most critical, as it determines your medical expenses, lost wages, diminished earning capacity, and overall quality of life. The settlement awarded also includes reimbursement for property damage, and in extreme cases of negligence, the court may choose to award additional compensation to further punish the wrongdoer. Settlements can range from thousands to millions of dollars.
